Why doesn't the court own and maintain the transcript?

Why isn't the court transcript on the court docket?

...because the practice hides and enables the kangaroo court.​

The court transcript is a record of your trial. You need it to appeal. The  expectation is that the court owns transcripts and maintain them in a safe place where they cannot be tampered with and where litigants can access them into the future.

 

But this is not true. Court transcripts, at least in Santa Barbara California, are owned by the court transcriber who have no law degree without procedures for how they will be maintained and kept safe.

 

Court Reform: Courts must maintain court transcript on the court docket a long with the other court documents for each case; a secure location. The contracts with court recorders must be modified for the courts to own transcripts.​

 

There is no legal reason for the court transcriber to own the court transcript. Employees and contractors give up their rights to product all the time. I consistently did as a consultant writer in high tech.

Note: I spoke recently to an attorney about my suggestion for court reform and he responded "It costs money for the transcript". But it shouldn't and won't if the court simply modifies it's contract with court reporters so the court owns the transcripts.
