Student Loan Crisis
EdFinancal LLC, a servicer for my alleged student loan, attempted to charge me 20% of my gross income - my social security even though they admit in their Memorandum of Points and Authoritie s, page 7, paragraph 4, lines 24–27, that “…it is ... unclear what type of loan..." In other words, even though EdFinancial states they know nothing about the loan they are servicing, they damaged my credit based on an unauthorized interest rate and they get away with it because of judicial chicanery in violation of the judge's oath.
The Most Misrepresented Document - The Proof of Service
On August 6, 2024 I properly served 'EdFinancial
using the address on the Secretary of Website at the
time of service using a professional service company.
Here is a copy of proof of service that was filed..
However, Judge Stern ruled in favor of EdFinancial, finding that I did not properly serve them at the address listed on the Secretary of State’s website that I used in August 2024. This ruling relied on a motion EdFinancial filed on 1/10/2025, the Friday before the hearing on 1/13/2025, which cited an address from the Secretary of State’s website dated December 2024.
Bhe only relevant date, however, is the date of service in August 2024. Judge Stern then gave EdFinancial a continuance without them even having to ask, applying a different standard since my late filings are always taken off calendar - never accepted with an automatic continuance given. The following is what I used in August at the adddress provided.
This is what EdFinancial filed.
In the minute order on 2/11/2026 by Judge Stern,
she falsely claimed I did not provide a proof of
service for my 2nd opposition on 2/62026 when
this is false. Why? She also claims that 411/35
applies to my case when it does NOT..
